Terms and Conditions

Before we get to the formal T&Cs stuff, we just wanted to jump in with a few general notes about us and how we like to do business.

At Label Wines we always try our best not to be big on rules, and after all we are talking about wine here, which really is supposed to enjoyable, interesting, fun and stress reducing. However, having all aspects of our offering clearly defined and in accordance with all rules and regulations is obviously of the utmost importance, and with that the formalities below are indeed an important read. We also pride ourselves in finding flexible and desirable solutions for all existing or potential customers, so please feel free to get in touch to discuss any aspect of our terms, conditions, offerings or services.

We aim to operate Label Wines as a small community or a family as we like to think of it, and as any great family we want to offer respect, openness, communication, understanding and support – and all we are asking for is the same in return.

We must warn you that the below T&Cs have been prepared by our Legal Team, so it might not be super entertaining, but obviously important nonetheless…

Label Wines reserves the right to change or update any of the information contained herein. It is your responsibility to review the Terms & Conditions at each visit to the site.

1. Definitions and Formalities

Label Wines is a trading name of the Australian registered company Alici Pty Ltd, with Australian Business Number 79 128 760 145 and Australian Wine and Brandy Corporation Exporters License Number 3825. “Label Wines” means Alici Pty Ltd and includes any of the directors, shareholders, officers, employees, agents, third party content providers, other representatives, or associated entities. The “Label Wines website” means www.labelwines.com, www.labelwines.com.au, and any other similar sub-domains, and is also referred to as “the service” or “the website”.

The terms of use are governed by the laws of New South Wales, Australia. You agree to submit to the jurisdiction of the courts of New South Wales, Australia and any appellate courts in relation to any disputes arising from your use of the Label Wines website. You agree and acknowledge that your failure to follow the rules set forth in this Agreement may subject you to civil and criminal liability.

All images and text on this website are the copyright of Alici Pty Ltd and may not be reproduced, published, broadcasted, transmitted, or adapted in any form without the permission of Alici Pty Ltd except as provided for by the Copyright Act 1968 (Commonwealth of Australia). The wines, wine names, club names, events and written copy on the Label Wines website are also protected by Trademarks and Copyright. Any other companies and/or products mentioned on the website may be the trademarks of their respective owners and should be treated as such.

 

2. Orders

A buyer may make an order for goods from Label Wines by any or all of the following means: Online, email, phone, fax, regular mail, or in person. The placement of an order is deemed to be acceptance of the terms and conditions contained in this document. The buyer is responsible to ensure that all details supplied relating to the order are accurate. Label Wines does not accept responsibility for any inaccuracies of address etc that cause the order to be misdirected or delayed, however, we will endeavor to find and redirect where possible.

A contract will exist between Label Wines and the Buyer once Label Wines has received and processed payment for the order. Products will not be dispatched until payment has been cleared.

Label Wines will endeavor to ensure the accuracy and availability of all products on order lists, however, we cannot guarantee availability. If an ordered product becomes unavailable, we will contact you to advise and offer other options.

All prices on all order forms and lists are subject to change and Label Wines reserves the right to apply current prices to all orders received. The customer may freely cancel an order following such changes.

Label Wines guarantees the product for any defects caused in the manufacture and packaging of the product. For products like wine, where the enjoyment is subjective in nature, no guarantees can be made as to the individual’s perception of the product. Any issues should be brought back to Label Wines without unreasonable delay.

The placement of an order is conditional on the buyer being in full compliance with the relevant laws and customs in place in the BUYERS country at the time the order is placed. In particular, you must obey the laws regarding the purchase of alcohol by minors (those under the legal drinking age of their country). Label Wines supports the policies regarding drinking in moderation and strictly adheres to the rules of only selling alcohol to those of legal age.

By placing an order, the customer also authorizes Label Wines to arrange for orders to be grouped for customs clearance purposes, and declared along with another related customers. The declaring party will assume responsibility for the private import and any arising duties, which again will be refunded by Label Wines, and will also be responsible for handing over the declared wine to the related parties without any surcharge or sales related effort. The customer also confirms that the wine will be for private consumption and not used for sale or revenue generating activities.

For all deliveries in Sweden, our prices in the web shop are excluding Swedish duties and taxes. It is the responsibility of the customer to ensure all necessary steps for the private import has been taken in accordance with the information available from the Swedish customs office. Label Wines will not have any responsibility for any subsequent tax or duty claims arising from the import towards the customer.

 

3. Wine Club Subscriptions

By registering as a member in the Label Wine Club you commit to purchasing periodic wine deliveries distributed at the frequency defined on your chosen membership. The timing and composition of all such deliveries are regulated by the information provided during registration and as described under Wine Club on the website. Each delivery under the subscription is treated as an individual order with terms as defined under point 2 above. You can skip your next delivery or cancel your membership on your Wine Club account page. You can do this at any time until the defined processing date communicated for each cycle. Given that we have limited memberships and a healthy waiting list, we do reserve the right to remove a member from the Club if their membership is not in use or we are unable to process or safely deliver their scheduled cases.

You consent to being charged the agreed amounts via direct debit on the credit card supplied on or around the time of your next scheduled delivery. Or if other payment arrangements have been specifically made, you accept that a payment obligation has arisen at that time and a liability to make timely payment has been created. Note that we do not store your credit card details on our website – they are held by our secure third-party payment gateway. It is the members responsibility to ensure delivery address and credit card details are correct and valid at the time of processing and the details can be updated at any time on your Wine Club account page. If your payment fails on the scheduled processing date, we will advise you of this in an email and make further attempts to process the payment on subsequent days. If each attempted payment fails and you contact us at a later time or date to make payment, we cannot guarantee availability and delivery at that time.

When connecting to other members through the Wine Club, each member provides confirmation to Label Wines of a close natured relationship with all other members. This authorizes Label Wines to, at their discretion, view the connected persons as related parties for legislative purposes, and where applicable, any customs clearances can be made to any one of the people in such a group. If contacted by authorities in relation to any such customs clearance, please contact Label Wines and we will be able to provide both network information and any other documentation.

We will contact you primarily via email to communicate important information about your membership. It is your responsibility to ensure that our emails are not being sent to your spam folder. If you are not receiving any emails in regards to your Wine Club membership, please contact us right away.

 

4. Returns and Cooling Off

Label Wines will at all times adhere to all Returns Policies and Cooling-Off Periods applicable for online sales in each of our delivery countries. For more specific information relevant for your country, please feel free to e-mail us on contact@labelwines.com. Please also refer to our general returns policy stated below under Corporate Policies, and our separate page on the Returns process.

 

5. Disclaimer

Label Wines is not in any way liable to you or any third party for any loss whatsoever associated with your use of this website, including but not limited to loss associated with:

  • Any errors or omissions in the information or for any information that is not accurate, up to date or complete. Label Wines may without notice update the contents of the website from time to time and makes no representations or warranties of any kind with respect to the website or its contents.
  • Any interference with or damage to your computer systems associated with your use or inability to use this website, including, but not limited to, loss of data, income or profit, loss of or damage to property, claims of third parties, interruptions, deletion of files or email, errors, defects, viruses or anything else capable of interfering with or damaging the operation of your computer systems, delays in operation or transmission or any failure of performance, whether or not resulting from acts of God, communications failure, theft, destruction or unauthorized access to Label Wines records, programs or services.

This is a comprehensive limitation of liability and under no circumstances shall Label Wines or any party involved in creating or producing the Label Wines website, be liable for any compensatory, direct, indirect, incidental, special, or consequential damages, that result from the use of or inability to use the Label Wines website.

All credit card information collected on the Label Wines website is securely processed and stored through our payment provider. Any issues related to this will be referred to and resolved through the provider and their Terms & Conditions.

Label Wines makes no representations or warranties about the suitability, accuracy or currency of the contents of this website, lack of viruses or any other matter whatsoever with respect to this website or contents. The website is provided on an “as is” basis without warranty of any kind. Label Wines hereby disclaims all representations, warranties and other terms with regard to this website including all implied terms as to merchantability and fitness for purpose. If and to the extent any state or country does not permit the exclusion or limitation of liability for consequential or incidental damages, Label Wines liability, in such state or country, shall be limited to the fullest extent permitted by law.

This website may from time to time contain links to other web sites. These linked websites are not under the control of Label Wines and Label Wines is not responsible for the content of these websites. Label Wines provides the links to you for convenience and in no way endorses or recommends the information or contents of the linked sites or the owners or operators of them.

You may not use the Label Wines website for any purpose that is unlawful or prohibited by laws which apply to you or in your location.  You may not use the website in a manner which could interfere with or damage the website.

Label Wines takes your privacy seriously. We understand that you may be concerned with the use of information collected about you online. As a result, we’ve developed this Privacy Policy to inform you of exactly how we use the information that you provide to us or that is collected by us.

We may update this Policy from time to time, so please check back occasionally. If you have any questions about our Privacy Policy, please do not hesitate to contact us.

Our company policy and staff are committed to protecting your privacy and to securing any information about you we hold. We will store and use the information securely, with regular reviews of our security. We will undertake all measures in our power to ensure your information remains protected, and vigorously pursue any breaches of security using all appropriate means, including legal action if necessary. Label Wines can not, however, assume any liability should such information nevertheless be obtained and misused by a third party

We will only collect & hold information that you voluntarily provide to us; e.g. in the course of becoming a Label Wine Club member, or by purchasing our products or participating in our services. The type of information we collect are; name, address, contact (phones, fax, email), credit card details provided by you for recurring membership payments and any other information relevant for your Label Wines purchase.

Any email address you supply to us will only be used to confirm orders or inform you about offers that you have signed up to be noticed about. You can at all times choose to unsubscribe to any such mailing lists you have signed up for.

When registering to become a member of the Label Wine Club or make similar purchases on the Label Wines website, you will be required to provide us with different levels of your personal information. We use this information to process your orders seamlessly and to contact you regarding these orders and deliveries. Your account information is stored in a password-protected database so you do not have to enter it again throughout the website and may be sent via e-mail with notifications from the site.

In cases of referrals or recommendations, you will need to provide us with information like your name, e-mail address and the name and e-mail address of the person you are sending it to. We will store also this information securely and only use it to process the recommendation.

Product Reviews

You may decide to review some of our products to inform other users of the site. When doing this, you might also provide us with personal details along with your review of the product. This information is stored in the site database and can be displayed on the relevant product page at our discretion. We reserve the right to delete or edit any such submitted material found by us to be inappropriate.

Placing an Order or Joining the Wine Club

When placing an order or joining the Wine Club, you will need to provide us with all the necessary details to fulfil your order or membership and deliver it safely to you. Details of your order are saved on the site database and are also e-mailed to yourself and to our sales and memberships department. Generally, these details are the same as those used when you registered with the site and will be filled in automatically.

When contacting Label Wines via our website, we require that you provide us with at least your name and e-mail address. Any other personal information you wish to give is voluntary. We do not store this information, but only use it in the event that your enquiry requires a response.

Log Files & Cookies

Cookies are small bits of information saved to your browser that might be used for the duration of the session or to identify the users for a later visit. These cookies might be used to track user statistics, auto-fill login information or settings on the website.

7. Corporate Policies

Delivery

Our delivery services will at all times be governed by the specific terms set forth during the ordering process. This includes, but is not limited to, all items like cost, timing, method, and mode of delivery. As our delivery times depend on items like international sea-freight, air freight and local delivery, no guarantee can be made as to the accuracy of the delivery estimates set forth at time of order placement. Label Wines assumes no responsibility for disruptions in the delivery process resulting from random Acts of God (Force Majeure). It is the responsibility of the buyer and the local delivery company that delivery adheres to local drinking age regulations.

Label Wines regularly use private couriers or third-party delivery companies to distribute our products. While we monitor their activity and expect a reasonable level of conduct, we cannot be responsible for their actions, delays, or losses. The product is generally dispatched uninsured, but as customer service, we will generally replace lost or damaged deliveries, if a secure delivery address was given. Further insurance can be arranged at the customer’s request. We are happy to assist you in contacting couriers and delivery companies regarding any experienced delivery problems and will always attempt to assist in any complaint resolution process. Returns

Again, your happiness is our mission! So, if your order arrives late or damaged, please advise us immediately. We will aim to replace any breakages that occur during transit as quickly as possible. Similarly, if there is a problem with your order or delivered products, please contact us and we will aim to resolve the matter. We do not necessarily accept returns if you change your mind after your order has been sent, so please choose carefully, and check your order before sending payment. Responsible Alcohol

Label Wines encourages the consumption of alcoholic beverages only by persons of legal drinking age. You must be of legal drinking age in your country to buy wine from this site. Wine should always be enjoyed in moderation.

Under the NSW Liquor Act 2007, it is against the law to sell or supply alcohol to, or to obtain alcohol on behalf of, a person under the age of 18 years. It is the buyer’s responsibility to ensure the applicable laws regulating purchase of alcohol and legal drinking age in the country of delivery is adhered to.

As a retailer and distributor of alcoholic beverages, Label Wines support and encourage all initiatives to protect and care for everyone’s wellbeing.
